The National Treasury and the South African Revenue Service (SARS) have launched a public consultation on the 2017 Draft Taxation Laws Amendment Bill (TLAB) and the 2017 Draft Tax Administration Laws Amendment Bill.

One of the most important and yet debated amendments proposed according to SAICA employees tax and expatriate sub-committees chairperson Tarryn Atkinson was the removal of the foreign remuneration exemption. “This section allowed employees to prevent the incurral of double tax based on their residence in South Africa and the source of their remuneration in a foreign country if certain criteria were met.”

Atkinson added that the effect of the proposed amendment is complicated and broad on both employees of multinationals and for the multinationals themselves. The draft amendments can be accessed here.
